STANDARD TERMS AND CONDITIONS OF SALE

for PONDEROSA HEARTH AND HOME

  1. These Terms and Conditions (“Agreement”) govern all sales and services provided by Ponderosa Hearth and Home (“Seller”) to its customers (“Buyer”). By signing and approving a quote or invoice, the Buyer acknowledges acceptance of the following terms:
  2. Quotes & Estimates
    1. All quotes are valid for 30 days from the date of issue unless otherwise stated.
    2. Pricing on quotes is subject to change due to manufacturer pricing, freight costs, or market conditions. Any adjustments will be communicated prior to final invoicing.
    3. Quotes are estimates only and may not reflect final charges for installation, special orders, or custom services unless clearly itemized.
  3. Orders & Payments
    1. A 50% deposit is required to place an order. Full payment is due prior to delivery, pickup, or installation unless otherwise agreed in writing.
    2. Accepted payment methods include cash, check, and major credit cards. Returned checks are subject to a $35 NSF fee.
    3. Unpaid balances over 30 days past due may be subject to 1.5% monthly interest (18% annual rate) and collections proceedings.
  4. Special Orders
    1. Special orders are non-refundable and non-cancellable once placed with the manufacturer.
    2. Lead times for special orders are estimates only and are subject to delays from manufacturers or freight carriers beyond our control.
    3. Buyer is responsible for verifying specifications, dimensions, and finishes of special-order items.
  5. Cancellations & Returns
    1. Cancellations must be made in writing and are subject to approval.
    2. Standard, in-stock items may be returned within 15 days of purchase with original receipt and in unopened, resaleable condition. A 20% restocking fee will apply.
    3. No returns or refunds on installed items, used items, custom items, or special orders.
  6. Delivery & Storage
    1. Delivery fees vary based on location and delivery requirements and will be outlined in the quote.
    2. If product delivery is delayed at the Buyer’s request or due to a jobsite not being ready, Ponderosa Hearth and Home reserves the right to charge a storage fee of $50 per week after 14 days.
    3. Buyer assumes responsibility for product condition upon acceptance at delivery or pick-up.
  7. Installation Services
    1. Installation quotes are based on information provided at the time of estimate. If site conditions differ, additional charges may apply.
    2. Buyer is responsible for securing all required permits, unless specifically included in the quote.
    3. Seller is not responsible for delays due to site access issues, other trades, weather, or code compliance issues unknown at the time of quoting.
    4. Installation warranties are limited to workmanship for 1 year from the date of completion. Manufacturer warranties apply separately.
  8. Product Warranties
    1. All products are covered by manufacturer warranties only. Ponderosa Hearth and Home does not provide additional warranties unless specified in writing.
    2. Warranty claims must be submitted in accordance with manufacturer procedures.
    3. Seller is not responsible for damage due to misuse, improper installation (if not installed by Seller), or lack of maintenance.
  9. Contractor Accounts
    1. Contractors must provide a valid contractor’s license number and resale certificate (if applicable) to qualify for trade pricing.
    2. Contractors are responsible for verifying all dimensions, clearances, and local code requirements for their job sites.
    3. Ponderosa Hearth and Home is not responsible for errors in measurements, product compatibility, or installation performed by the contractor or their sub-contractors.
  10. Limitation of Liability
    1. Under no circumstances shall Ponderosa Hearth and Home be liable for indirect, incidental, or consequential damages.
    2. Total liability shall not exceed the amount paid by the Buyer for the product or service in dispute.
  11. Force Majeure
    1. Seller shall not be held responsible for delays or failure to perform due to events beyond its reasonable control, including but not limited to acts of God, labor strikes, pandemics, supply chain disruptions, or natural disasters.
  12. Governing Law & Disputes
    1. These terms are governed by the laws of the State of California.
    2. Any disputes arising under this Agreement will be resolved in the courts located in Fresno County, California.
  13. Agreement & Acceptance

By signing below or electronically accepting a quote or invoice, Buyer acknowledges they have read, understood, and agreed to these Terms and Conditions.
